Managing REACH

As all products comprise of chemicals, REACH applies to most materials & finished goods. REACH interlinks with other regulatory frameworks on environmental, occupational & consumer protection.

Key to the EU Market

REACH is based on a 'no data, no market' approach. This applies to each manufacturer or importer of a substance under the scope of REACH.

Under REACH, substances must be pre-registered & registered. Once pre-registered, companies must form Substance Information Exchange Forums (SIEFs) to share relevant data for the purpose of assessing chemical risks. Certain data must be shared & costs divided accordingly. Substances may also face evaluation & authorisation, while bans may be enacted on other products.

Non-EU manufacturers, formulators & producers of finished goods can appoint EU-based Only Representatives to meet the obligations of EU importers on their behalf. In this way, access to the EU market is based on compliance by an EU-based company.

Finished Products

While REACH primarily covers substances & mixtures in materials, containers or devices, there are additional complex requirements for finished goods. In particular, substances on a 'Candidate List' for Authorisation must be communicated through the supply chain, if present at or above 0.1% w/w in a finished product. Under REACH, suppliers & retailers must respond to consumer requests for such information within 45 days.
